1. Acceptance of Agreement -Approval of this proposal and payment of the required deposit constitute acceptance of these Terms & Conditions and form a binding agreement between the Client and Tree Service & Consulting LLC.

 

2. Deposits & Cancellations -The required deposit is earned upon receipt and reserves the Client's place on our schedule while covering estimating, planning, administrative, mobilization, and scheduling costs. Deposits are non-refundable if the Client cancels the project after acceptance.

 

3. Payment -Unless otherwise agreed in writing, payment in full is due immediately upon completion of the work. Past-due balances may be subject to interest and collection costs as permitted by law.

 

4. Additional Work -Any work requested outside the approved proposal requires approval and may result in additional charges.

 

5. Hidden Conditions -Pricing is based on visible site conditions. Tree Service & Consulting LLC is not responsible for hidden defects or unforeseen conditions, including underground utilities, irrigation systems, drainage lines, septic systems, landscape lighting, embedded metal, or other concealed improvements. Discovery of such conditions may require additional charges.

 

6. Property Access -The Client is responsible for providing safe and reasonable access to the work area. Delays or return trips caused by restricted access may result in additional charges.

 

7. Weather & Safety -Work may be postponed due to weather, equipment failure, or other unsafe conditions and will be rescheduled as practical

 

8. Debris -Unless otherwise stated, all debris generated by the contracted work will be removed. Firewood, logs, or wood chips may be left at the Client's request.

 

9. Permits -Unless specifically included in the proposal, permits and approvals are the responsibility of the Client.

 

10. Oak Wilt Prevention- Oak pruning will be performed in accordance with industry standards. Fresh pruning wounds may be sealed when appropriate to reduce the risk of oak wilt transmission. All Pruning equipment sanitized before & after job.

 

11. Photographs -Tree Service & Consulting LLC may photograph the property before, during, and after the project for documentation, quality assurance, and marketing unless the Client objects in writing before work begins.

 

12. Limitation of Liability -Tree Service & Consulting LLC will perform work in accordance with accepted arboricultural standards. Liability is limited to the amount paid under this agreement, except where prohibited by law.

13. Governing Law -This agreement shall be governed by the laws of the State of Texas.
